Terms of Service

By visiting ownazents.ai, creating an account, or using any feature of the Ownazents platform ("Service"), you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree with any part of these Terms, you must not use the Service. We may update these Terms at any time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

Ownazents is a managed AI agent platform. We allow individuals and businesses to create, configure, and deploy custom AI agents powered by large language models (including Anthropic's Claude). Your agent can:

• Respond to messages on Telegram, WhatsApp, and other connected channels
• Browse the web, draft and send emails, summarise information, and conduct research
• Schedule tasks, set reminders, and execute multi-step automations
• Process and act on instructions you provide via a Standard Operating Procedure (SOP)
• Integrate with external tools and APIs as configured by you

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. We will provide at least 14 days' notice for significant feature removals that affect paying customers.

To use Ownazents you must:

• Be at least 18 years old (or have parental/guardian consent if 16–17)
• Provide accurate and up-to-date information during registration
• Maintain the security of your login credentials
• Promptly notify us of any unauthorised access to your account

You are solely responsible for:

• All activity that occurs under your account
• The actions your AI agent takes on your behalf
• Compliance with any third-party platform policies (e.g., Telegram's Terms, WhatsApp Business Policy)
• Not sharing your account with others or creating multiple accounts to circumvent plan limits

You agree to use Ownazents only for lawful purposes and in a manner consistent with these Terms. You must not use the Service to:

5.1 Credit System

Ownazents uses a credit system. Credits are consumed each time your AI agent performs an action. Simple actions (e.g., a short reply) cost 1 credit; complex tasks (e.g., multi-step web research) may cost 2–10 credits.

5.2 Plans & Billing

• Free plan includes 200 credits/month — no credit card required
• Credits included with paid plans are listed on the Pricing page
• Credits reset on the 1st of each calendar month and do not roll over to the next month
• When credits are exhausted, your agent will pause until credits reset or you upgrade
• All payments are processed in USD by Stripe and charged monthly in advance

5.3 Refunds & Cancellations

• All payments are non-refundable except where required by applicable law
• You may cancel your subscription at any time; your plan remains active until the end of the billing period
• Downgrading mid-cycle does not trigger a partial refund
• If we discontinue the Service entirely, we will provide a pro-rated refund for prepaid unused periods

5.4 Price Changes

We may adjust pricing at any time. For existing paying customers, we will provide at least 30 days' written notice (by email) before any price increase takes effect.

You retain full ownership of all content you provide to the Service — including agent instructions, files, knowledge base documents, and conversation history ("Your Content").

By using the Service, you grant Ownazents a limited, worldwide, non-exclusive, royalty-free licence to access, store, process, and transmit Your Content solely as necessary to provide the Service to you. This licence terminates when you delete the content or close your account.

You are solely responsible for ensuring that Your Content and your agent's actions comply with all applicable laws. Ownazents is not liable for any content your agent generates or transmits on your behalf.

AI language models, including Claude by Anthropic, are probabilistic systems. They can produce inaccurate, incomplete, or misleading outputs. Ownazents does not guarantee that your agent will:

• Always produce accurate, factual, or correct responses
• Successfully complete every task assigned to it
• Maintain 100% uptime (we target 99.5% monthly uptime for paid plans)
• Behave identically across different versions of the underlying model

The Ownazents platform, brand, logo, website design, source code, and all associated intellectual property are owned by Ownazents and protected under applicable copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, modify, create derivative works from, distribute, or publicly display any part of the Service or our brand assets without prior written consent from Ownazents.

Content generated by your AI agent on your explicit instruction belongs to you, subject to any restrictions in Anthropic's usage policies and applicable copyright law.

To the maximum extent permitted by applicable law, Ownazents and its founders, employees, and contractors shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from errors or omissions in AI-generated content
• Damages caused by third-party services we use (Anthropic, Supabase, Stripe, etc.)
• Service interruptions or downtime, however caused

Our total cumulative liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the total fees you paid us in the 3 months preceding the claim, or (b) INR 5,000 (approximately $60 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain types of damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.

10.1 By You

You may cancel your account at any time from the account dashboard or by emailing support@ownazents.ai. Upon cancellation:

• Your paid plan remains active until the end of the current billing period
• Your agents are deactivated after the billing period ends
• Your personal data is deleted within 30 days (see Privacy Policy for exceptions)
• No refund is issued for the unused portion of the current billing period

10.2 By Us

We may suspend or terminate your account immediately, without notice or liability, if you materially breach these Terms — including violations of the Acceptable Use Policy. We may also suspend accounts for non-payment after a 7-day grace period.

We reserve the right to discontinue the Service entirely with 30 days' written notice to all users, and will provide a pro-rated refund for unused prepaid credits.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 of India, with the seat of arbitration in Hyderabad, Telangana.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from the courts of Hyderabad, India.
